Իշխանությունների զազրելի գործողությունները՝ կեղծված ընտրություններից հետո

Օհանյան-Րաֆֆի-Օսկանյան դաշինքի հայտարարությունը 

Ապրիլի 2-ի կեղծված ընտրություններին հետևեցին իշխանությունների ոչ պակաս զազրելի գործողությունները:

Ապրիլի 14-ին Վարչական դատարանը, իշխող ՀՀԿ-ի քաղաքական ղեկավարության ակնհայտ ուղղորդմամբ, մերժեց Օհանյան-Րաֆֆի-Օսկանյան դաշինքի հայցադիմումը, որով պահանջվում էր պարտավորեցնել ԿԸՀ-ին ստեղծել ընտրությունների ժամանակ էլեկտրոնային հատուկ սարքերում կուտակված մատնահետքերի միասնական բազա և կատարել դրանց համադրում՝ բացահայտելու համար կրկնաքվեարկությունները: Այսպիսով, ևս մեկ անգամ փաստվեց, որ Հայաստանի Հանրապետության ներկայիս արդարադատության համակարգը ծառայում է ոչ թե արդարության և օրինականության ապահովմանը այլ իշխանությունների պարտադրված կեղծիքին:

Մինչ այդ՝ ապրիլի 12-ին, ՀՀ Վճռաբեկ դատարանը մերժել է Վերաքննիչ դատարանի կողմից Անդրիաս Ղուկասյանի հանդեպ կալանքի կիրառման և գրավի միջնորդության վերաբերյալ մերժման դեմ բողոքը: Այսպիսով, Անդրիաս Ղուկասյանը մյուս բոլոր քաղկալանավորների և քաղբանտարկյալների պես շարունակում է մնալ ճաղերի ետևում:

Մինչդեռ այսպես կոչված մարդու իրավունքների պաշտպանը քաղաքացիների իրավունքները պաշտպանելու փոխարեն, գերազանցելով իր լիազորությունները և ստանձնելով դատախազի կարգավիճակ, օրերս հանդես եկավ մեղադրական «եզրակացություններով»՝ Սարի թաղի դեպքերի հետևանքով մինչ օրս քաղաքական հետապնդումների ենթարկվող քաղաքական գործիչների և քաղաքացիական ակտիվիստների գործողությունների մասին: Նշված գործով քննությունն ավարտական փուլում է, և շուտով գործերը քննվելու են դատարանում, և դժվար չէ կռահել թե ինչին է փորձում իշխանությունների պատվերով նախապատրաստել հասարակական կարծիքը մարդու իրավունքների կեղծ պաշտպանը:

Զուգահեռաբար իշխող վարչախումբը հարձակում է գործում իր ապօրինությունների բացահայտման ուղղությամբ քայլեր կատարած քաղհասարակության ներկայացուցիչների հանդեպ: ՀՀԿ-ական ուսուցիչների կողմից նախընտրական շրջանում ադմինիստրատիվ ռեսուրսի չարաշահումը բացահայտած «Իրազեկ քաղաքացիների միավորում» հասարակական կազմակերպության դեմ 30 ուսուցիչների կողմից հայցերի կազմակերպված ներկայացումը դատարան ևս պետք է դիտարկել քաղաքական հաշվեհարդարի շրջանակներում: Այսպիսով, իշխանությունները իրենց կամակատարների ապօրինությունների իրավական գնահատականը տալու և դրանց հեղինակներին պատժելու փոխարեն քաղաքական հետապնդում են սկսել այդ ապօրինությունները բացահայտած հասարակական կազմակերպության դեմ:

ՍԱՍ սուպերմարկետների ցանցի սեփականատեր, ՀՀԿ-ի անդամ Արտակ Սարգսյանի օգտին սեփական աշխատակիցներից ձայներ կորզելու՝ օրերս բացահայտված ապօրինի մեթոդաբանությունը ևս այլ կերպ, քան հաշվեհարդարի սպառնալիքներով ուղեկցվող քաղաքական հետապնդում անվանել հնարավոր չէ:

Օհանյան-Րաֆֆի-Օսկանյան դաշինքը դատապարտում է վերը թվարկված բոլոր ապօրինությունները և իր զորակցությունը հայտնում բոլոր քաղբանտարկյալներին և քաղաքական հետապնդումների ենթարկվող քաղաքացիներին և կազմակերպություններին:

School Chiefs Sue Civic Group Over Pre-Election Scandal

The directors of 30 public schools and kindergartens have sued an Armenian civil society group that tricked them into confessing that they told their staffs and children’s parents to vote for the ruling Republican Party (HHK) in this month’s parliamentary elections.

They are seeking a formal apology and a total of 60 million drams ($124,000) in damages for the scandalous revelations which they say compromised their “honor and dignity.”

The Union of Informed Citizens (UIC) revealed late last month that its activists posing as HHK representatives telephoned 136 schools and kindergarten chiefs across Armenia. It said 114 of them admitted drawing up lists of children’s parents as well as schoolteachers and kindergarten staff who pledged support for the HHK in the April 2 polls.

The UIC said the lists were submitted to local government bodies or HHK campaign offices. It also publicized audio of those phone conversations.

Armenian opposition forces portrayed the revelations as further proof of their allegations of HHK foul play in the parliamentary race. Some of them demanded that the Central Election Commission (CEC) seek a court ruling that would disqualify the HHK from the race. The CEC rejected those demands.

The HHK admitted that many school principals are campaigning for its election victory. But it claimed that they are doing so “beyond their work hours and work duties.”

An HHK deputy chairman, Armen Ashotian, approved of the lawsuit when he spoke to RFE/RL’s Armenian service (Azatutyun.am) on Tuesday.

Harutiun Harutiunian, a lawyer representing the plaintiffs, claimed that the UIC revelations amounted to defamation of character. “My clients unequivocally assert that they did not abuse administrative resources,” he said.

Daniel Ioannisian, an UIC activist, countered that his civic group accused the ruling party, rather than the principals, of such abuses. “Let the Republican Party sue us and say that it didn’t abuse administrative resources,” he said. “In that case, we would have something to discuss.”

“We didn’t say that the principals are abusing administrative resources,” Ioannisian told RFE/RL’s Armenian service (Azatutyun.am). “We only presented facts and evaluated the whole thing.”

The activist also claimed that the legal action was orchestrated by the HHK leadership in retaliation against the embarrassing revelations. It is aimed at restricting freedom of expression in Armenia, he said.

In a preliminary report released on April 3, European election observers mentioned the UIC recordings in the context of “credible reports of pressure and intimidation on voters, especially on private and public sector employees.”

Tankian Blasts Lawsuit Against Armenian Civic Group

Armenian-American rock musician Serj Tankian has condemned the pro-government directors of 30 schools and kindergartens in Armenia for suing a civic organization that exposed their highly controversial involvement in the ruling HHK party’s parliamentary election campaign.

“Someone bringing attention to corruption and injustice should be praised not prosecuted,” Tankian wrote on his Facebook page on Wednesday.

“If the school principals involved feel embarrassed at the revelation of their inappropriate actions, they should go after those that put them in that position, not a journalist,” he said.

The vast majority of them admitted drawing up lists of students’ parents as well as schoolteachers and kindergarten staff who pledged to vote for the HHK.

The UIC said the lists were submitted to local government bodies or HHK campaign offices. It portrayed audio recordings of the phone conversations as further proof that the ruling party is abusing its administrative resources to win the elections.

Tankian met with Ioannisian and other civic activists when he arrived in Armenia late last month to monitor the vote together with several other ethnic Armenian artists from the United States and Canada. In his Facebook message, the lead singer of the rock band System Of A Down praised Ioannisian for his “efforts in journalistic activism.”

The court case against the UIC has also been denounced by other Armenian society representatives as well as the opposition Congress-HZhK alliance.

“This is the authorities’ style,” Levon Zurabian, a leading member of the alliance, told RFE/RL’s Armenian service (Azatutyun.am) on Thursday. “When they organize electoral fraud at a state level and when we present evidence of that, it turns out afterwards that the law was broken not by the person who gave vote bribes but the person who exposed them.”

Zurabian also decried the fact that the overwhelming majority of school principals in Armenia are affiliated with the HHK.

The HHK leadership has defended the controversial lawsuit, while denying that it told the school chiefs to take the UIC to court. Armen Ashotian, a deputy chairman of the party, said on Wednesday that the principals are right to defend themselves against “information aggression.”

Ruling Party Rocked By Another Election Scandal

The ruling Republican Party of Armenia (HHK) has come under more fire following the publication of secretly recorded audio purportedly indicating that employees of one of its wealthy parliamentarians were told to campaign for his reelection or lose their jobs.

The Hayastan24.com website posted on Thursday the recording of what it called a staff meeting that was held by businessman Artak Sargsian’s senior aides in the run-up to the April 2 parliamentary elections. It features the voice of an unknown man threatening to fire those employees of Sargsian’s SAS supermarket chain in Yerevan who have failed to guarantee in writing that their friends and relatives will vote for the HHK member.

“For example, Anush Adamian has brought 14 votes, let’s applaud Anush Adamian,” says the man. “How come Anush can bring [so many votes] but Ashot Aghakhanian can’t?

“Why haven’t you brought votes? You don’t want to? If you treat us like that, then we’ll treat you five times as badly.”

The man goes on to praise another woman, Irina Nazarian, who he says promised to earn Sargsian 44 votes and will be rewarded handsomely. “You’ll rock the elections, get the tickets to Paris, go there, have a lot of fun, come back and your [higher] position will await you. Agreed?”

The Office of the Prosecutor-General told RFE/RL’s Armenian service (Azatutyun.am) on Friday that it is “examining” the 40-minute audio which was swiftly disseminated by Armenian media outlets and social media users. Even before its emergence, the HHK faced many opposition and media allegations of foul play in the elections.

Sargsian, who managed to secure reelection in a Yerevan constituency, did not comment on the embarrassing recording as of Friday evening. The 43-year businessman has held a seat in Armenia’s parliament since 2004. He has not made public statements on the parliament floor for at least five years.

Sargsian and other wealthy HHK candidates running for the parliament already faced last month media allegations that they are bullying their workers and bribing many other voters for electoral purposes.

The HHK’s parliamentary leader, Vahram Baghdasarian, reacted cautiously to the scandal. He said that law-enforcement bodies should determine whether the audio is authentic and, if so, whether Sargsian was aware of the staff meeting.

“Journalists and political forces are quite inventive these days,” said Baghdasarian. “So it may have been a ploy. But I don’t rule out anything. We will address this topic after the examinations.”

At least one opposition group, the Congress-HZhK alliance, seized upon the recording, calling it further proof that the ruling party illegally used its administrative and financial levers to win the April 2 elections. The Congress-HZhK’s Aram Manukian said the alliance will use the audio in its appeal to the Constitutional Court aimed at annulling the official vote results.

In their preliminary report on the elections released on April 3, European observers cited “credible information about vote-buying, and pressure on civil servants and employees of private companies.”

Եվրոպական դատարանը կքննի Արտակ Նազարյանի գործը

30-ամյա սպան մահացել է Տավուշի մարզի զորամասերից մեկի դիրքերում՝ 2010 թվականին:

Եվրոպական դատարանը կքննի 7 տարի առաջ բանակում մահացած պայմանագրային զինծառայող Արտակ Նազարյանի գործը։

Ստրասբուրգի դատարանը Հայաստանի կառավարությանը 16 շաբաթ ժամանակ է տվել՝ պատասխանելու մի շարք հարցերի, մասնավորապես, արդյո՞ք խախտվել է Նազարյանի կյանքի իրավունքը:

30-ամյա երիտասարդի հարազատները, ինչպես նաև այս գործով տուժողի կողմի ներկայացուցիչները բազմիցս են պնդել, որ զինծառայողը ոչ թե ինքնասպան է եղել, ինչպես նշվում է նաև հայաստանյան դատարանների վճռում, այլ նրան սպանել են։

Արտակ Նազարյանի քույրը՝ տուժողի իրավահաջորդ Ծովինար Նազարյանը պնդում է, որ հայաստանյան դատարանները պատշաճ քննություն չիրականացրեցին՝ եղբոր մահվան իրական հանգամանքները բացահայտելու համար։

«Ես վստահ եմ, որ հանցագործները մինչև հիմա բանակում են, առոք-փառոք շարունակում են իրենց, այսպես կոչված, ծառայությունը, շարունակում են վտանգ ներկայացնել այլ զինծառայողների համար», - ասաց Նազարյանը։

Ծովինար Նազարյանը հիշում է այդ օրերին իր ընտանիքի ապրումները, ասում է՝ մինչև հիմա պայքարում են՝ հասնելու արդարադատության թեկուզ դրսում։

«Ունենք չորս տարվա աշխատանք, որը մեզանից խլեց հոգեկան, ֆիզիկական և նյութական մեծ ռեսուրսներ, մայրս ու հայրս ուղղակի շատ ծանր տարան այդ ամեն ինչը, հայրս վերջերս վախճանվեց», - նշեց Արտակ Նազարյանի քույրը։

Նազարյանի հարազատներն ու այս գործով փաստաբանները տարիներ շարունակ հայտարարում են, որ թե՛ նախաքննությունը, թե՛ դատավարությունը բազմաթիվ խախտումներով են անցել, իսկ իրենց պնդումները, որ բանակում տեղի է ունեցել սպանություն, արհամարհվել է։

«Դատարանը որոշում կայացնելիս հաշվի է առել միայն դատախազի կարծիքը՝ խախտելով մեր արդար դատաքննության իրավունքը», - պնդում է սպայի քույրն ու հիշում դատաքննության ավարտը, երբ դատախազը ընթերցեց նույն մեղադրանքը, որն առկա է եղել սկզբում՝ դրանով իսկ անտեսելով ողջ դատավարության ընթացքում իրենց բարձրաձայնած խախտումները։

«Զենքի վրա չեն հայտնաբերվել մատնահետքեր, որ մահից առաջ նա ստացել էր 120 փամփուշտ և մահից հետո 120 փամփուշտ էլ հայտնաբերվել է նրա մոտ։ Հիշեցնեմ, որ պարկուճը, որը հայտնաբերվել էր դեպքի վայրում մի համարի էր, իսկ փորձաքննության ենթարկվել է մեկ այլ համարի պարկուճ, որ գնդակը չի հայտնաբերվել դեպքի վայրում, ասում են՝ «թռել, գնացել է ադրբեջանական կողմ», որ Արտակի գլխարկը մնացել էր գլխին կրակոցից հետո և լուսանկարներում մենք տեսանք, որ փոքրիկ անցք կա, որը բացարձակ արյունոտ չի, նախաքննության ընթացքում մենք աղմուկ բարձրացրեցինք այդ մասին», - ասաց Ծովինար Նազարյանը։

Եվրոպական դատարանը Հայաստանի կառավարությունից պահանջել է նաև զորամասի վերաբերյալ փաստաթղթեր ներկայացնել: Տուժող կողմը շարունակում է պնդել, որ վկա զինվորներին ճնշումների են ենթարկել։

«Ապօրինաբար պահել են մեկուսարանում՝ 10-ից 27 օր, շուրջ տասը զինծառայողի 10-ից մինչև 27 օր պահել են մեկուսարանում։ Բերել են, մեզ է ներկայացրել դատարանում գնդի նախկին հրամանատարը, թե իբր ինքն է հրաման տվել պահելու, սակայն, ո՛չ առաջին դեպքում, ո՛չ երկրորդ դեպքում որևէ օրինական փաստաթուղթ, թե ինչի համար են պահել այդ զինվորներին մեկուսարանում, մենք առ այսօր չունենք», - «Ազատության» հետ զրույցում ասաց տուժողի իրավահաջորդի ներկայացուցիչ Ռուբեն Մարտիրոսյանը։

Նա պնդում է, որ Արտակ Նազարյանի մարմնի վնասվածքներն այդպես էլ քննության առարկա չդարձան, քննության առարկա չդարձան նաև այլ գործոններ։

«Դեպքի վայրը փոխված է, բոլոր զինվորները տեսել են, թե ոնց են Նազարյանին սպանում, այն, ինչ-որ ես ձեզ ասում եմ, բոլորը փաստաթղթերով փորձագիտական եզրակացություններով հիմնավորված են, սակայն հանցավոր քննիչ-դատախազները բացարձակապես անտեսել են փաստերը՝ փորձագիտական եզրակացությունների տվյալները, և վերցրել են, գործը ձևակերպել են որպես ինքնասպանություն», - ասաց Մարտիրոսյանը։

30-ամյա սպա Արտակ Նազարյանը մահացել է Տավուշի մարզի զորամասերից մեկի դիրքերում՝ 2010 թվականին: Սպային ինքնասպանության հասցնելու համար մեղադրվում էին նրա հինգ ծառայակիցները, որոնք տարբեր պատժաչափերով դատապարտվեցին։ Նրանք, սակայն, չընդունեցին մեղադրանքը։

«Կոնգրես – ՀԺԿ» դաշինքը Սահմանադրական դատարանում կբողոքարկի ԱԺ ընտրությունների արդյունքները

«Կոնգրես-ՀԺԿ» դաշինքը որոշել է բողոքարկել խորհրդարանական ընտրությունների արդյունքների օրինականությունը Սահմանադրական դատարանում՝ այդ ընտրություններն անվավեր ճանաչելու պահանջով: Քիչ առաջ դաշինքը հանդես է եկել հայտարարությամբ, որում, նշված է․

«2017 թվականի ապրիլի 2-ի Ազգային Ժողովի ընտրություններն անցան իշխանության կողմից կազմակերպված զանգվածային և համակարգված օրինախախտումների կիրառությամբ: Այդ օրինախախտումները ներառում են.

- Սահմանադրության խախտմամբ ընտրությունների օրվա նշանակումը։

- Ընտրակաշառքի զանգվածային բաժանումը, քաղաքացիների անձնագրերի և նույնականացման քարտերի ապօրինի հավաքումը, իրավապահ մարմինների անգործությունը:

- Ընտրողների ահաբեկումը, վարչական լծակներով և կրիմինալի ներգրավմամբ ճնշումների լայնածավալ կիրառումը: Ոստիկանության օժանդակությամբ ընտրողներին պարտադրված զանգվածային վերագրանցումների կատարումը։ Տեղամասային կենտրոններում օրենքի խախտմամբ կուտակումները և անկառավարելի վիճակի ստեղծումը, այդ կապակցությամբ ոստիկանության անգործությունը:

- Քվեարկության գաղտնիության համատարած խախտումը, ներառյալ վերահսկված ու բաց քվեարկությունը, այդ թվում գունավոր գրիչների, գունավոր և համարակալած թղթիկների կիրառման միջոցով: Ընտրողների բացահայտ ապօրինի ուղղորդումը, ինքնուրույն քվեարկելու խնդիրներ ունեցող ընտրողներին օգնելու դրույթի չարաշահումը:

- Քվեարկության ընթացքի նկատմամբ հասարակական վերահսկողությունը խոչընդոտելու նպատակով, տեղամասերում տեղադրված տեսախցիկների միջոցով ինտերնետային հեռարձակման դադարեցումը` քվեարկության օրվա 7.00-ից 13.00-ը ընկած ժամանակահատվածում, ինչը համընկավ ընտրողների ակնհայտորեն կազմակերպված գերակտիվ հոսքի հետ:

- Կրկնակի քվեարկության բազմաթիվ արձանագրված դեպքերը։

- Բռնության և ահաբեկման դեպքերը լրագրողների, վստահված անձանց և դիտորդների նկատմամբ:

Այսպիսով, հաշվի առնելով, որ հերթական անգամ կոպտորեն ոտնահարվել է ժողովրդավարությունը և ընտրական գործընթացի լայնածավալ և կազմակերպված խախտումները բացառել են ժողովրդի ազատ կամարտահայտությունը,

Նպատակ ունենալով հանարավորություն տալ քաղաքական ուժերին և քաղաքացիական հասարակությանը իրավական գնահատական տալու խախտումների մասին արձանագրված փաստերին,

«Կոնգրես-ՀԺԿ» դաշինքը որոշել է բողոքարկել ընտրությունների արդյունքների օրինականությունը և լիազորել ապրիլի 2-ի ընտրություններում դիտորդական առաքելություն իրականացրած «Քաղաքացի դիտորդ» հասարակական կազմակերպության ներկայացուցիչ Տիգրան Եգորյանին՝ ներկայացնելու «Կոնգրես-ՀԺԿ» դաշինքի բողոքը ԿԸՀ և Սահմանդրական դատարան՝ 2017թ․ապրիլի 2-ի ընտրությունները անվավեր ճանաչելու պահանջով»:

Ապրիլի 7-ի դրությամբ ընտրախախտումների փաստերով հարուցվել է 10 քրգործ․ Քննչական կոմիտե

Մասնավորապես, Քննչական կոմիտեի Լոռու մարզային քննչական վարչությունում քննվող քրեական գործով մեղադրանք է առաջադրվել՝ թիվ 23/02 ընտրատեղամասում մեկից ավելի անգամ քվեարկելու փորձ կատարելու համար:

«2017թ. ապրիլի 2-ին հաղորդում է ստացվել առ այն, որ Վանաձոր քաղաքի թիվ 23/02 ընտատեղամսում ժամը 09:13-ի ահմաններում կրկին քվեարկելու փորձ է գրանցվել: Դեպքի առթիվ ՀՀ ՔԿ Լոռու մարզային քննչական վարչությունում հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգքրի 34-153-րդ հոդվածով, և ձեռնարկվել անհրաժեշտ քննչական գործողություններ՝ դեպքի հանգամանքները պարզելու ուղղությամբ:

Նախնական քննությամբ փաստական տվյալներ են ձեռք բերվել առ այն, որ թիվ 23/02 ընտրատեղամասի ընտրող Ա. Հովհաննիսյանն ապրիլի 2-ի առավոտյան, օրենքով սահմանված կարգով, մասնակցել է ԱԺ ընտրություններին, սակայն քվեարկությունը կատարելուց որոշ ժամանակ անց կրկին գնացել է նույն ընտրատեղամաս և փորձել նորից գրանցվել՝ քվեարկելու համար։ Նույնականացման սարքի ազդանշանն անմիջապես միացել է, որի արդյունքում հանձնաժողովը կանխել է մեկից ավելի անգամ քվեարկելու փորձը:

Ձեռք բերված բավարար ապացույցների հիման վրա՝ 2017թ. ապրիլի 6-ին Ա. Հովհաննիսյանին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 34-153-րդ հոդվածով, և նրա նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն՝ չհեռանալու մասին:

Ապրիլի 7-ի դրությամբ, ապրիլի 2-ին տեղի ունեցած ԱԺ ընտրությունների ընթացքում մեկից ավելի անգամ քվեարկելու փորձ կատարելու դեպքերի վերաբերյալ հարուցվել է 10 քրեական գործ, որոնցով նախաքննությունն իրականացվում է ՀՀ ՔԿ տարածքային ստորաբաժանումների վարույթում։ 8 քրեական գործով մեղադրանք է առաջադրվել 8 անձի, որոնցից 3-ով՝ հայտարարվել է նախաքննության ավարտի մասին և քրեական գործերը՝ մեղադրական եզրակացությամբ, ուղարկվել նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին»,- նշված է ՔԿ հաղորդագրության մեջ։

Civic Groups Report ‘Evidence Of Election Fraud

A coalition of Armenian civil society organizations claimed on Wednesday to have obtained evidence that at least several hundred ballots were cast in place of citizens who did not vote in the April 2 parliamentary elections.

The Citizen Observer grouping, which deployed over 3,000 election observers, began scrutinizing on Tuesday the nationwide lists of all Armenians who took part in the vote, according to the Central Election Commission (CEC).

Publication of those signed lists was one of several major anti-fraud amendments to the Electoral Code enacted last fall in line with an agreement reached by the Armenian government and the opposition. Another amendment led to the introduction of electronic voter authentication devices in all polling stations. These measures were meant to prevent multiple voting by government supporters.

In the run-up to the elections, the Citizen Observer asked Armenians who did not plan to vote or live abroad to register on its website so that in can verify whether other people voted illegally on behalf of them. According to Tigran Yegorian, a Citizen Observer legal expert, around 10,000 such citizens responded to the appeal.

“We have compared data from only about 100 of the 2,009 precincts and found that there was voting in place of 800 of the 10,000 people who declared their non-participation in the elections beforehand,” Yegorian told RFE/RL’s Armenian service (Azatutyun.am). This number may well increase as the Citizen Observer is continuing to examine the lists, he said.

Yegorian also said that several other people have personally informed civic activists that they or their relatives did not vote but are shown by the official documents to have cast ballots.

Shushan Davtian, a 20-year-old woman currently studying in Europe, also looked at the lists posted on the CEC website and found that someone else forged her signature and voted in her place. “Frankly, I was very surprised,” she told RFE/RL’s Armenian service (Azatutyun.am) by phone.

Davtian suggested that officials in her precinct in Yerevan’s Avan district may have known that she will not be in Armenia on election day.

The CEC did not immediately respond to the Citizen Observer claims.

Under the Electoral Code, all complaints relating to suspected multiple voting had to be submitted to the commission by Wednesday morning. Yegorian said the Citizen Observer could not meet that deadline because the CEC delayed the publication of the signed lists by several hours on Tuesday. The commission should therefore agree to consider a formal complaint that will be lodged by the civic groups later this week, he said.

Western election observers and Armenian opposition parties and blocs did not report significant cases of multiple voting in Sunday’s elections. The opposition forces also did not allege serious irregularities in the post-election voter lists as of Wednesday evening.

Dashnaktsutyun Reports Vote Irregularities

The Armenian Revolutionary Federation (Dashnaktsutyun), President Serzh Sarkisian’s junior coalition partner, expressed concern at serious irregularities which it said were committed in two Armenian provinces during Sunday’s parliamentary elections.

Aghvan Vartanian, a leader of the party, singled out voting in Chambarak, a small town in the northeastern Gegharkunik province, and some parts of the central Aragatsotn province. He said he appealed to the head of Armenia’s Central Election Commission and Prosecutor-General Artur Davtian.

Vartanian was particularly concerned about the situation in Chambarak. He claimed that government loyalists forced proxies of Dashnaktsutyun and opposition parties and blocs running in the elections to leave local polling stations.

Vartanian also reported open voting, a “fairly chaotic situation” and even scuffles in some Aragatsotn villages. He blamed them on a local election candidate of the ruling Republican Party of Armenia (HHK).

An RFE/RL correspondent visited a polling station in Chambarak, witnessing groups of suspicious men standing inside and just outside it. One of those men held a stack of papers which he described as ballot samples. He refused to identify himself and hastily walked away when approached by the reporter.

Another man was writing something in a notebook that seemed to contain the names of voters. He too refused to identify himself or explain his actions.

The chairwoman of the local precinct election commission, Karine Grigorian, denied the presence of any unauthorized personnel there. Still, she told some of those men to leave the polling station moments after noticing the reporter.

Groups of unknown individuals, some of them transporting and guiding voters, were also a fixture outside polling stations across Gyumri, the country’s second largest city. One woman, who is known as a supporter of a local HHK candidate, admitted “bringing people to the elections” when she spoke to RFE/RL’s Armenian service. “And I’m now going to bring in more of them,” she said.

Arus Hovannisian, a Gyumri candidate of Gagik Tsarukian’s bloc, angrily argued with members of a local precinct commission after alleging “carousel voting” by citizens presumably bribed by the HHK. The election officials denied the claims.

Opposition parties and independent election monitors reported hundreds of mostly procedural violations throughout the voting. The vote-monitoring group Citizen Observer said most of the violations witnessed by its activists across the country involved breaches of the secrecy of the ballot and pressure exerted on voters.

In a statement issued two hours before the closure of the polls, Levon Ter-Petrosian’s opposition Congress-HZhK alliance similarly alleged “widespread” open voting. In some cases, it said, election officials or other government backers “stood behind polling booths and watched voters.”

Meanwhile, the Office of the Prosecutor-General said it has looked into more than 1,300 media and opposition reports of irregularities as of 6 p.m. local time and instructed the police and other law-enforcement bodies to investigate 226 of them. It said in most of those cases there was alleged multiple voting, vote buying, open voting, and obstruction of the work of journalists, observers and candidate proxies.

In a separate statement, the prosecutors said they told the Investigative Committee to consider launching criminal proceedings against a village mayor in Gegharkunik who was accused of “guiding” voters and ordering a violent attack on a proxy.

Ruling Party Downplays Vote Buying

The ruling Republican Party of Armenia (HHK) on Wednesday admitted that vote bribes were distributed during the weekend parliamentary elections but insisted that they did not significantly affect the vote results.

Eduard Sharmazanov, the HHK spokesman, argued that the elections did not spark opposition demonstrations. He also emphasized the fact that the United States and the European Union gave largely positive assessments of their conduct. “No votes were stolen,” he told RFE/RL’s Armenian service (Azatutyun.am).

Asked about reports of widespread vote buying, Sharmazanov said: “I can’t exclude that, if everyone talks about that. I haven’t come from the Moon. I won’t be an honest person if I say ‘of course nothing happened.’ If everyone says it, then it’s not a ghost, there is some truth in it.”

The official insisted, however, that the illegal practice did not have a “substantial impact on the election results” that that gave a landslide victory to the HHK. “Secondly, the overwhelming majority of reports about vote irregularities were false alerts,” he said.

“Thirdly, for the first time in 10-15 years people have not taken to the streets [to protest election results,]” Sharmazanov went on. “This means that the public accepts the results. This is a legitimate election.”

In their preliminary report released on Monday, Western observers mostly deployed by the OSCE said although “fundamental freedoms were generally respected” Sunday’s vote was “tainted by credible information about vote-buying, and pressure on civil servants and employees of private companies.” But they did not report significant instances of multiple voting or ballot stuffing.

The U.S. and the EU echoed the findings of the OSCE-led mission, while cautiously praising the overall conduct of the polls on Tuesday. The EU foreign policy chief, Federica Mogherini, said through a spokesperson that the official results reflect “the overall will of the Armenian people.”

The Armenian opposition parties and blocs say that the HHK retained its control of the parliament thanks to vote buying and abuse of government resources. But none of them has urged supporters to take to the streets.
