The lawyers of the victim of the violence, occurred in the territory of “Harsnaqar” restaurant complex on June 17, submitted their appropriate mediations for the second time after getting acquainted with the materials of the criminal case,
The lawyers demanded in to carry out a full examination of the territory of Harsanaqar restaurant complex in order to reveal where the cameras have been installed, or in case of dismantling the cameras after the crime, what parts those have been installed in. They also demanded to recognize all the CPUs in the restaurant complex as evidence, along with the already confiscated CPU and show them to professionals, to reveal, whether the discs on the CPU contain any video files of the day of crime or not, and in case of absence of these files, would it be possible, that those have been deleted from the electronic discs. Besides, they’ve mediated to carry out a comparative test on the difference between the time setup of the confiscated CPU and the real time.
According to the testimony of Ruben Hayrapetyan, on June 17 of 2012 he has been in Sevan and after returning from there he visited "Harsnaqar" restaurant complex for a short time, around 19.00, and then at FFA "Technical Center Academy". According to the telephone decoding provided by Vivacell, Harsnaqar employees Arthur Babloyan, Norayr Hayrapetyan, Arman Khachatryan, Arman Baghdasaryan, Garik Margaryan have also been in Sevan from the afternoon, from about 14.00 to 19.00, on the same day, and according to the telephone decoding provided by “Beeline” (Armentel) and “Karabagh telecom” companies, the latters’ route has supposedly been the same as Ruben Hayrapetyan’s. Judging from the data of antennas, between 19.30-22.40 they have been in the territory of "Harsnaqar" restaurant and /or FFA. "Ruben Hayrapetyan’s connection to this crime should’ve been suspended due to the fact, that even the member of his own body guard- Gagik Margaryan simply refused to answer to the enquiry of having an order to beat Vahe Avetyan and Ruben Hayrapetya’s presence at “Harsnaqar” restaurant complex at the moment of beating Vahe Avetyan. If Ruben Hayrapetyan really didn’t have any connection to this crime, then what did stop one of his “soldiers” to deny that connection?” said lawyer Lusine Hakobyan.
The lawyers mediated to involve Ruben Hayrapetyan in the case as a suspend, taking into account the fact, that finally the very responsible issues of beating the clients, obviously can be solved only under the auspices of the owner and submitted a mediation to the court to receive the decoding of his telephone numbers, to question the accused concerning these issues. In general, the fact of identification of the numbers is also ridiculous in the sense, that the phone numbers used by the accused have been checked only based on their announcements. This can prove the fact, that the preliminary investigative body has made no effort to reveal whether the accused had any other telephone numbers or not, and reveal the call list of that telephone numbers.
The biggest run-out and the mistake of the preliminary investigative body of this criminal case is the fact, that until now they haven’t revealed who caused the mortal blow (blows) to Vahe Avetyan. Thus, Vahe Avetyan’s murder has not been revealed by the preliminary investigative group, but by accumulating and compiling 3 volumes of documents they are trying to create the impression that the crime has been revealed, or more precisely, in that manner they are trying to conceal it.
"It is obvious that the only aim of the preliminary investigative body is not to disclose the culprits and not to hand to the justice, and on the other hand, to provide the already accused persons with necessary accusations, to be recognized innocent and clean-handed before the court,” said lawyer Lusine Hayrapetyan. In their mediations the lawyers asked to satisfy and provide the realization of all the above mentioned mediations, to restart the preliminary investigation of this criminal case, to implement all the investigative actions towards the satisfaction of the mentioned mediations, to reveal the complete image of the crime, to provide the multilateralism of the preliminary investigation, to re-qualify the causing of mortal blow to Vahe Avetyan as murder, to reveal the persons who committed the murder and to propose them accusations equivalent to their action. But few hours after submitting the mediations, Ruben Mkrtchyan informed the lawyers on the phone, that the mediation has been rejected, and the decision on rejection will be sent by post much later.
